Seattle, Washington (CNN) The family of a man mistakenly shot and killed by Los Angeles Sheriff's Deputies has filed a 25 million dollar claim against the department.

30-year-old John Winkler was one of three people held captive at knifepoint inside an apartment on April 7th.

Deputies fired at Winkler when he ran out the door, thinking he was the suspect.

Winkler's family, who live in Washington State, say they are suing to get the true story.

"Our family wants to find out the truth of what happened that night. And we want those officers to be held accountable for their actions and what they've no other family has to go through this nightmare,” says Lisa Ostergren, the victim's mother.

The sheriff's department has admitted the mistake and has launched an internal investigation.

Deputies say their description of the attacker was a white man with a thin build wearing a black shirt and Winkler was wearing a black shirt at the time.
