Boise, Idaho ( KBOI-TV ) Last month, four same sex couples sued the Governor... and an Ada County clerk for not allowing them to get a marriage license.
Last week the Attorney General's Office asked to be included in the lawsuit along with the Governor.
State Attorney General Lawrence Wasden says it's his job to defend the Constitution of Idaho, which only recognizes marriage as being between a man and woman.
Even though there have been other judgments against same sex laws in other states, Wasden says he will still defend the case.
"Our obligation is to make a legal argument to defense of the constitutional choices made by the people in the state of Idaho," he explains.
Wasden says that even though the Supreme Court struck down the Defense of Marriage Act, or DOMA, the Idaho Constitution does not violate that judgment.
