A Murtaugh resident facing sexually related charges was in a Rupert courtroom, the judge sent the man back to jail for violating his terms of release.

In November, 62 year Charles Leon Bailey of Murtaugh was charged with two counts of lewd conduct with a child under the age of 16, and criminal solicitation to commit a crime, all in Minidoka County.

One of the solicitation charges was amended to lewd conduct and bailey pled not guilty to all counts in December.

Bailey's $100,000 bail was reduced to $25,000 and he was released on house arrest. Bailey was allowed to go to work, and attend Alcoholics Anonymous classes in Burley and Paul.

But witnesses testified that bailey was at JB's Restaurant inBburley, twice, during April and March when there weren't AA meetings.

Fifth District Judge Barry Wood addressed Bailey and said, “Going to the understanding of house arrest, it's difficult for me to believe that someone has such a tentative grasp of the obvious that they don't understand what house arrest means.”

Judge Wood revoked Bailey's Bond and turned him over to the Minidoka County Sheriff's Office to be readmitted to the county jail. Bailey’s trial will be rescheduled from its original date of June 10th.
