A Magic Valley resident was in court today on related drug charges in an attempt to change his plea.

Keith Allen Gentry of Hazelton is charged with drug trafficking in marijuana. He was stopped by a Twin Falls County Deputy on Highway 93 on an initial report of a possible DUI

Gentry was arrested for being in possession of 9 pounds of marijuana. He was hoping to change his plea from guilty to not guilty, in light of the parallels to the Arizona vs. Gant case.

Defense attorney Robin Weeks says that case may prohibit the police from performing a search that could lead to suppression.

Judge Stoker allowed Gentry to withdraw from his guilty plea and granted his counsel to file for a motion to suppress evidence.
