Fifth District Judge Robert Elgee heard an appeal from The Friends of Minidoka against Jerome County Tuesday.

In the appeal, attorneys for The Friends of Minidoka and nearby residents lobbied to include additional documents in the case file.

The attorneys say that the Jerome County Board of Commissioners closed the record too soon.

Judge Elgee asked if the additional documents were admitted, then what comes next?

Attorneys for Jerome County and Big Sky Farms, which has been issued a permit for a confined animal feeding operation east of Jerome, expressed their frustration with the attorneys for Minidoka not following the judge's specific orders when it came to spelling out what they wanted to accomplish in this case.

This is the second appeal of the Jerome County Commissioners' decision two years ago.
