A Rupert resident charged with attempted murder, two counts of aggravated assault, robbery with a deadly weapon, and grand theft, was in court in Burley for a motions hearing Tuesday.
David James Prano's attorney asked Fifth District Judge Michael Crabtree if a four-wheeler, held as evidence by the sheriff's department, could be released back to Prano. Crabtree denied this request.
Prano and two other people are accused of robbing a victim who thought he was purchasing a used a-t-v.
Police say at the time of the robbery, a vehicle not connected to the incident, was passing through the location, and several shots were fired at it.
The defense also requested the right to examine this vehicle. Crabtree also denied the request.
