ACLU Files Suit Over Fatal Border Shooting

Tucson, Arizona (CNN) - The ACLU filed a federal lawsuit Tuesday against U.S. Border patrol agents who shot and killed a Mexican teenager.
16-year-old Jose Antonio Elena Rodriguez was killed in 2012 near the U.S.-Mexico border.
He was standing in Mexico, and the border patrol agents were in Arizona.
Lee Gelernt ACLU Attorney said, "We anticipate that the government will not want to defend this case on the facts, on the merits, and will seek to have this case thrown out by claiming that the United States Constitution does not apply to Mexican nationals on foreign soil."
Border patrol agents said they saw smugglers drop drugs at the border, and people were throwing rocks at them before the shooting.
