Accused sex offender allowed to watch child porn in jail

TACOMA, Washington (CNN) An accused sex offender is watching child porn in jail, and it's within his rights to do so! Now, lawmakers in Washington State, are trying to change the law.

Marc Gilbert, accused child rapist says, "I'm asking for both of the copies of the hard drives as well as the copies of the videotapes be released."

That's Marc Gilbert acting as his own attorney.

The judge has ruled by doing so, Gilbert has the legal right to view all evidence against him. It includes hours and hours of pornography.

Some of it allegedly made by Gilbert himself, involving young boys.
And he gets to view it in jail.

Sen. Mike Carrell (R) Washington State says, "I was shocked."

When Sen. Carrell heard about our initial story, he immediately set out to get the law changed.

Sen. Carrell says, "the viewing by somebody charged with child pornography, to be able to continue to view children is just simply wrong and it's illegal, as far as I'm concerned."

Standby attorney John Henry Browne states, "I don't blame people for being outraged. If they knew the whole story they may be less outraged."

John Henry Browne is Gilbert's standby attorney, assisting him if he needs it. He says this is a constitutional issue.

The state supreme court has ruled a defendant who acts as his own attorney gets to see all the evidence.

"People can have whatever opinions they want. The law says he's allowed to do what he's doing. And unless they want to change the constitution that's not going to change."

This is not the first time he's seen the videos while in custody. Gilbert saw these tapes a year ago while in federal lockup.

He pleaded guilty to federal charges and given a 25 year sentence.

Senator Carrell says he's undeterred and will introduce legislation as soon as he can. Sen. Carrell says, "where they would not be allowed to continue their prurient interests in looking at child pornography by continuing to view it."
