James Holmes May Plead Guilty To Avoid Death Penalty

By Paul Johnson

(CNN) - The defense for movie theatre shooter, James Holmes offers a guilty plea for life in prison, without the opportunity for parole according documents filed with the court.
The prosecution in the case has not accepted this offer because it may still be seeking the death penalty according to the filing. The defense says in their offer that they are still exploring a mental health defense. If the prosecution elects not to seek the death penalty the defense says the case could be resolved on April 1.
CNN is working to confirm reports that Colorado movie-theater shooting suspect James Holmes's defense attorneys are offering to have him plead guilty to avoid the death penalty. There are also reports that the prosecution has not accepted the deal.
The latest court filing is only available at the courthouse- not online- and we are relying on affiliates to share it with us. NCC has calls into the public defenders' and prosecutors' offices.
