TWIN FALLS, Id. ( KMVT - KSVT ) The Twin Falls County Prosecuting Attorney will not be filing criminal charges related to the death of an infant at St. Luke’s Magic Valley.
Seven month old August Elliot died in September of last year after a nurse gave him the wrong medication.
Today, the prosecuting attorney's office released a statement explaining why they are not filing charges.
In part, the statement says while the nurse, identified as Jeffrey Smith, did make a mistake that ultimately led to Elliot's death, his actions did not amount to criminal negligence.
Shortly after the prosecuting attorney's office released their statement, St. Lukes responded and said in part, “At St. Luke’s, we remain deeply saddened by August’s death and vigilant in our efforts to minimize the risk that such an incident could occur again. We have been active in our response and the specific procedures we have put in place have been validated by surveyors from the Centers for Medicare and Medicaid Services (CMS). The community can feel confident that our commitment to safe, quality care will not waiver.”
